Abstract

With the increasing adoption of digital learning environments in India, concerns about privacy have become more prominent. This paper examines the need to protect privacy in digital learning spaces, considering incidents of data breaches and unauthorized access to personal information. The focus is on the legal framework governing privacy in India, particularly in the context of education. The landmark case of Justice K.S. Puttaswamy (Retd) vs. Union of India, which recognized privacy as a fundamental right, is discussed. The paper argues that despite this recognition, privacy protection remains inadequate in digital learning environments. Recommendations for legislative changes to enhance privacy safeguards in education are provided.
